Privacy Policy

At AIKen ("we", "us") we build software and artificial intelligence solutions from Neuquén, Patagonia Argentina. This policy explains what personal data we collect through aiken.ar and our digital channels, what we use it for, and how you can exercise your rights. 1. Data we collect

We only collect the data you voluntarily provide, plus the minimum technical data generated by browsing:

• Contact data: name, email, phone, company and the message you send us when you fill in a contact form, request a demo or book a meeting.
• WhatsApp: your number and the messages you send when you write to us on WhatsApp from the site.
• Free diagnostic (/diagnostico): your name, your business name and industry, city and email; if you fill them in, your WhatsApp and Instagram; your answers; whether you want the newsletter; the IP address you submit it from and the date you agreed to us storing the data.
• Visit origin: which ad, campaign or site brought you here (utm parameters, Meta and Google click identifiers such as fbclid or gclid, landing page, referring site and date). It is stored in the aiken_origen cookie (see “Cookies”).
• Browsing data: IP address, browser and device type (user-agent), pages visited, traffic source and interaction events on the site.

2. How we use it

We use your data for the following purposes:

• Answering your enquiries and following up on our services.
• Scheduling the meetings or demos you request.
• Sending you communications or updates if you gave explicit consent. You can unsubscribe at any time from the link in every email.
• Understanding how the site is used in order to improve it (aggregate metrics, performance and usability).
• For the diagnostic: preparing the module and pricing recommendation for your business, emailing it to you and following up on it. The IP address is used to limit how many submissions a single connection can make per day.
• Measuring which ads and channels (Meta and, when we advertise there, Google Ads) bring enquiries, diagnostics and app trials. To do so, the visit origin travels with your enquiry or diagnostic, and the app (app.aiken.ar) reads it if you start a trial. On Google we do not use your data to show you personalised advertising (remarketing).

3. Legal basis and consent

We process your data based on your consent, given when you voluntarily submit a form, and on our legitimate interest in responding to your request and keeping the site secure and operational. We never sell, rent or trade your personal data with third parties.

To submit the diagnostic you must tick the box agreeing that we store your data and contact you about it; the newsletter is a separate, optional box.

Outside the European Economic Area, the United Kingdom and Switzerland, Google Analytics measurement and the Meta pixel start when you browse the site, and you can switch them off at any time with “Reject” or from the cookie settings in the notice. If you reject them, we do not store the aiken_origen cookie either, nor send the server-side event to Meta.

If you visit us from the European Economic Area, the United Kingdom or Switzerland, measurement and advertising cookies stay off until you accept them, and we process your data in line with the General Data Protection Regulation (GDPR): you also have the rights to object, to restrict processing and to data portability, and you may lodge a complaint with your local supervisory authority.

4. Third parties processing data

To operate the site and our communications we rely on providers that may process data on our behalf, under their own privacy policies:

• Cloudflare — infrastructure, site delivery, security, storage of the contact data you send us and delivery of confirmation emails.
• Google (Analytics, Ads and Workspace) — site usage metrics (Google Analytics 4), conversion measurement when we advertise on Google Ads, and work email.
• Microsoft Clarity — behaviour and usability analytics (recording of the session on the site). It only loads if you accept analytics cookies.
• Meta (Facebook, Instagram and WhatsApp) — the Meta pixel measures in your browser the visits, enquiries and diagnostics that come from our ads. When you submit the diagnostic, our server also notifies Meta through the Conversions API: it sends your email and phone number hashed (SHA-256, Meta does not receive the plain text), the IP address and browser you submitted from, and the Meta cookie identifiers (_fbp, _fbc). That event is only sent if you did not reject marketing cookies (in Europe, only if you accepted them). WhatsApp, when you choose to write to us there.
• Discord — internal notification to our team when a new enquiry arrives.
• Brevo — email communications.

5. Social media

We publish content on social networks (including Instagram, LinkedIn and TikTok). When you interact with our accounts, those platforms process your data under their own privacy policies, over which AIKen has no control. If you authorise us to publish on your behalf through an integration, we will only use that access to publish the agreed content, and you can revoke it at any time from the relevant platform settings.

6. Cookies

This site uses first-party and third-party cookies for analytics, ad measurement and functionality. When you arrive we show you a notice where you can accept or reject them, and your choice is remembered on later visits. You can also block or delete them from your browser settings; if you do, some features of the site may not work correctly.

AIKen’s own cookies are shared between aiken.ar and app.aiken.ar:

• aiken_cookie_consent — stores your choice in the cookie notice, so we do not ask again and the app can take it into account too. It lasts 1 year.
• aiken_origen — stores which ad or channel brought you the first and the last time (see “Data we collect”) and, if you took the diagnostic, its number. It tells us which ads bring businesses that try the app. It lasts 90 days and is not stored if you rejected marketing cookies.
• Third-party: Google Analytics (_ga), Meta (_fbp, _fbc), Google Ads when active, and Microsoft Clarity only if you accept analytics cookies.

7. Data retention

We keep your data for as long as a business relationship exists or until you request its deletion. Analytics data is retained in aggregate form according to each provider’s retention periods.

8. Your rights

Under Argentine Personal Data Protection Law No. 25.326, you have the right to access, rectify, update and delete your personal data. To exercise these rights, write to us at hola@aiken.ar and we will respond within the legal timeframes.

The Agency for Access to Public Information (AAIP), the enforcement authority for Law 25.326, is empowered to handle complaints and claims from individuals whose rights have been affected.

9. Security

We apply reasonable technical and organisational measures to protect your data against unauthorised access, loss or alteration, including encryption in transit (HTTPS) and access control to our systems. The details are on our Security page.

10. Changes to this policy

We may update this policy to reflect changes in our practices or in applicable regulations. The current version will always be published on this page, showing the date it was last updated.
